By accessing and/or using this Website, you acknowledge that you have read, understood and agree to be legally bound by these Terms and Conditions. If you do not agree to be bound by these Terms and Conditions, please do not continue the use of this Website. All text, graphics, design, content, and other works contained in this Website, including the name “Weaves of Tradition”, are either copyrighted works of Weaves of Tradition or of third parties mentioned therein. Weaves of Tradition acknowledges proprietary rights of third parties displayed on the Site. This Website is owned and controlled by Weaves of Tradition.

Use of the Website

These Terms and Conditions set out a legally binding agreement between the user (“you”, “your”, “customer”) and Weaves of Tradition (“we”, “our”, “us”), with reference to the Services provided by us through this Website.

By accessing this Website, you acknowledge that you are a major pursuant to the laws governing your place of residence and that you are therefore eligible to enter into a legally binding contract. Any person who is not a major as per the laws of their place of residence may not avail the Services without the consent of a guardian. Weaves of Tradition reserves the right to discontinue your subscription and terminate your account, if it occurs to us that you are not of the age of majority.

You may not use the Website, the Services or the products for illegal or unauthorized purposes. You must not transmit any worms or viruses or any code of a destructive nature. The breach or violation of any of the Terms and Conditions will result in the immediate termination of your account and/or legal action being initiated against you.

Services

This Website offers the sale and purchase of merchandize and services listed on the Website (the “Services”). We reserve the right to refuse the service to anyone for any reason at any time.

You agree not to sell, resell, reproduce, duplicate or copy any portion of the Services without our express written consent. We reserve the right to terminate the services provided to you if we determine that you are a reseller, an agent of a reseller.

Weaves of Tradition has the sole right to change or discontinue any Service at any time, without prior notice. Weaves of Tradition has the sole right to add or modify procedures, modes of payment, shipment and any other services pertaining to purchase at any time. Weaves of Tradition shall not be liable to you for any such changes to its Services.

Products

Title to the goods sold (“products”) as a part of the Services, shall transfer to you upon the completion of the payment for the Services.

We ensure that the quality of the products is equivalent to the quality of goods of a similar make and finish. We assume the standard and degree of care equivalent to that expected of similar goods and services sold on the online and off-line marketplaces and stores. Please read the product description that accompanies the product that you wish to purchase before you check-out and make payment. Product descriptions are provided so that you may make better purchasing decisions. We will not be liable for purchases made without understanding product description and any related information. Such purchases will be held to be made legitimately with full knowledge of the product being offered and will not be eligible for return or refund.

Handloom products may have defects that are intrinsic to the weaving process. Fabrics dyed with natural dyes and colours may bleed colour due to the use of traditional processes and natural dyes. Please read the product description and washing and care instructions for the use of such methods and the required washing and care for such products.

Except as otherwise provided in these Terms and Conditions and in individual products descriptions on the Website, we disclaim any and all other warranties and liabilities, either express or implied, including any warranties of title, merchantability or fitness for a particular purpose.

If a particular product that you wish to buy is out of stock, please write in to us at weavesoftradition@gmail.comfor further information. We do not guarantee that a particular product will be available at a certain point of time, however, we may be able to take certain orders on a one-off basis (“Custom Orders”). The payment for and order processing time for Custom Orders will differ from the products available on the Website. The terms and conditions for Custom Orders are to be determined between Weaves of Tradition and you separately.

Modifications to Prices

We reserve the right to modify the prices of the products at any point of time.

Cancellations and Returns

Orders may be cancelled before they are shipped. However, once the orders are shipped, cancellations may not be accepted. We do have Order Rejection facility. If your order is shipped, you must accept the shipment.

Returns will be entertained in the event of defects in the product. If you receive a defective product, please write in to us at weavesoftradition@gmail.com. We will assess the defect and determine if the product needs to be replaced or refunded altogether. Any such defect must be notified within 5 days from the date of receipt of the shipment.

We do not entertain returns for change of mind.

We reserve the right to cancel any order that you place with us. We may limit the number of purchases that are made from a particular address, household, credit card or customer account.

We do not provide the Services to resellers, dealers and distributors.

Refund

Refunds will be processed within 3-5 days of receipt of the returned product.

Payments

All payments need to be made online via our third-party payment partners. Orders will be shipped only upon receipt of the payment.

In the event that your payment fails to go through, we will get in touch with you to revise your payment within a period of 24 hours. If you fail to revise the payment within 24 hours, your order will be terminated.

Third Party Links

We use third party payment gateways and therefore you will find third party links on our Website. You will be bound by the terms and conditions of the payment partner that you choose for payment.

We are not responsible for examining or evaluating the content on third-party websites. Any complaints, grievances and issues related to third party websites must be taken up with the third party directly.

Shipping

We reserve the right to choose our shipping partners. Depending upon the shipping address and the shipping expenses we will choose a shipping partner that is both cost effective and timely.

Shipping time for products will be 3-4 days from the date of purchase. However, some products may be available on-order-basis and the shipping time for such products will be separately mentioned within the product description. You are expected to take note of the shipping time for on-order-basis products.

Shipping expenses will be available during checkout. For international orders, shipping will be calculated on the basis of weight of the shipment and the place of shipment.

Comments and Feedback

We encourage you to send us your feedback about our Services and products. However, we reserve the right to edit, copy, publish, distribute or translate such feedback and comments.

Your comments and feedback must not violate any law, any third-party rights, including, patents, copyrights, trademarks etc., or privacy or personality of any person. In the event that any provision of the Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from the Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

We may terminate your account at out sole discretion if we determine that you are in violation of any of the Terms and Conditions.

Entire Agreement

These Terms and Conditions together with the content of the Website, constitute an entire agreement between you and Weaves of Tradition. Any prior agreements, whether oral or written shall cease to operate as on the date of these Terms and Conditions.

Governing Law

These Terms and Conditions together with the Services and the Website shall be governed by the laws of the State of Karnataka and the Laws of India.
